Welcome to Spotatrain.com ("Spotatrain", "we", "our", or "the site"), a global rail tourism hub owned and operated by Geospotter Studios, based in Canada. By accessing, browsing, or contributing to Spotatrain.com, you ("you", "the user") agree to be bound by these Terms of Service ("Terms"). Please read them carefully. If you do not agree with any part of these Terms, you must not use the website. Continued use of the site after changes to these Terms constitutes acceptance of the revised Terms.

1. Eligibility and Accounts

You must be at least 16 years of age to create an account on Spotatrain.com. By registering, you represent that the information you provide is accurate and that you will keep your credentials secure. You are responsible for all activity that occurs under your account, including any content submitted, ratings posted, or interactions with other users. We reserve the right to suspend or terminate any account that violates these Terms, engages in fraudulent activity, or repeatedly submits inaccurate information.

2. Acceptable Use

You agree to use Spotatrain.com only for lawful purposes and in a manner consistent with the site's mission of celebrating responsible rail tourism. You may not:

  • Submit content that is illegal, defamatory, harassing, hateful, or sexually explicit.
  • Encourage trespassing on railway property or any unsafe behavior near trains or tracks.
  • Submit spotting locations on private property without the owner's permission, or on restricted railway infrastructure (yards, tunnels, signal cabins, bridges).
  • Upload photos or content that you do not own or have explicit permission to share.
  • Attempt to gain unauthorized access to user accounts, the database, or backend systems.
  • Use automated tools (bots, scrapers, crawlers) to extract data without prior written consent.
  • Interfere with the operation of the site, including by uploading malicious code or flooding the platform with spam.
  • Impersonate another person, organization, or railway operator.

Violation of these rules may result in content removal, account suspension, or legal action.

3. User-Generated Content

Spotatrain.com is, in part, a community platform. Registered users may submit spotting locations, photos, ratings, comments, and lists (collectively, "User Content"). You retain ownership of any User Content you submit. However, by submitting User Content to the platform, you grant Geospotter Studios a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, display, reproduce, modify (for cropping, resizing, and formatting purposes), and distribute that content on Spotatrain.com and across our official channels (newsletter, social media, marketing materials).

You represent and warrant that: (a) you own or have the necessary rights to all content you submit; (b) your content does not infringe the intellectual property, privacy, or other rights of any third party; and (c) your content does not contain false or misleading information about a location, an operator, or a person.

We reserve the right — but assume no obligation — to review, edit, reject, or remove any User Content at our sole discretion. Removal does not entitle you to compensation. If you wish to remove your own contributions, you may delete them from your profile or request removal via the contact form.

4. Intellectual Property

All site design, original editorial content, code, branding, logos, and the Spotatrain name and marks are the property of Geospotter Studios and are protected by Canadian and international copyright and trademark law. You may share links to public Spotatrain pages and quote brief excerpts of editorial text with proper attribution. You may not reproduce, republish, or redistribute substantial portions of the site's editorial content without prior written permission.

If you believe content on Spotatrain.com infringes your copyright, please contact us with the URL of the allegedly infringing content, identification of the original work, your contact details, and a statement of good-faith belief that the use is unauthorized. We will investigate promptly and remove infringing content where appropriate.

5. Third-Party Links and Services

Spotatrain.com contains links to third-party websites (railway operators, ticketing partners, photo platforms, advertisers, and informational resources). We are not responsible for the content, availability, accuracy, or practices of those sites. Following an external link is at your own risk, and you are encouraged to review the privacy and terms policies of any site you visit.

6. Disclaimer of Warranties

Spotatrain.com is provided "as is" and "as available". We make no warranties, express or implied, regarding the accuracy, completeness, reliability, or fitness for any particular purpose of the information available on the site, including spot coordinates, schedules, operator information, route geometry, journey pricing, and project status timelines. Information may become outdated or inaccurate without notice. Always verify schedules, access rights, and safety conditions with the relevant railway operator or local authorities before traveling.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Geospotter Studios, its directors, contributors, and partners shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of, or inability to use, the website — including injury, property damage, loss of data, or financial loss resulting from decisions made on the basis of information published on Spotatrain.com. Train watching and rail tourism involve inherent risks; you assume full responsibility for your own safety and conduct.

8. Indemnification

You agree to indemnify and hold harmless Geospotter Studios and its representatives from any claim, demand, loss, or damage — including reasonable legal fees — arising out of your breach of these Terms, your User Content, or your violation of any law or third-party right.

9. Account Termination

You may close your account at any time by contacting us. We may suspend or terminate your access to the site, with or without notice, if we determine that you have violated these Terms or engaged in conduct harmful to the platform or its community. Upon termination, your right to use the site ceases immediately. Your User Content may remain visible in cached or archival forms unless you specifically request removal.

10. Governing Law and Disputes

These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Any dispute arising out of or related to these Terms or the use of Spotatrain.com shall be resolved in the courts of Quebec, unless mandatory consumer protection laws of your country of residence apply.

11. Severability

If any provision of these Terms is found to be unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions shall continue in full force and effect.
